AWSA Newsflash - Civil Aviation Act - 19 March 2010

The date that the Civil Aviation Act of 2009, assented to by the President on 27 May 2009 (Government Gazette 32266), has been promulgated in Government Gazette 32958. The effective date is 31 March 2010, except for Sections of chapters 4 and 8 that will only come into effect at a later date.

1. PROPOSED AMENDMENTS TO PART 91

The proposed amendments to Part 91 have been published in Government Gazette 33015 dated 12 March 2010.

The proposed amendments are mainly of a textual nature or are minor modifications. The proposal does include some amendments that are interesting or might require consideration and comment. Examples of of such proposals are:

- It will become illegal to direct a beam of light towards an aircraft or control tower - 91.01.10
- A time check shall be obtained from and ATSU before flying in controlled airspace - 91.01.12

AWSA NEWSFLASH – AIC 20.21 WITHDRAWN

The monitors of AWSA received the following communiqué from Aero Club regarding the withdrawal of AIC 20.21 which related to restrictions in the use of Cape Town airspace. (See last week’s newsflash)

Quote:

“ CAA has kindly withdrawn the AIC 20.21 by issuing the NOTAM Nr A0938/10.

Aeroclub believes this matter will now follow the favorable usual consultation process and we look forward to working with the CAA and relevant Stakeholders to find a workable solution that will be desirable for all parties.

AWSA NEWSFLASH - CAPE TOWN AIRSPACE REVISITED

GA representative bodies, consisting of Aero Club, AOPA and CAASA,
challenged a recent move by the SACAA to restrict the use of
uncontrolled airspace in the Cape Town area by means of issuing AIC
20.21. Their contention rested on the fact that proper consultation
did not take place and that the matter was not submitted to NASCOM for
its recommendations.

Of particular concern was the fact that the AIC had the potential of
increasing the risk of a mid air collision due to aircraft movements

1. INCREASE IN FUEL LEVY

Gazette 32977 dated 26 February 2010 has been published and contains the increase in the SACAA fuel levy on aviation fuel. The increase is from 2.15 cents to 4.0 cents per litre from 1 April.

This increase is lower than announced to the industry.

SACAA FUEL LEVY TO INCREASE
At an industry meeting last week the CAA revealed its new budget to address its forecast deficit.

The Commissioner of Civil Aviation, Mr Colin Jordaan revealed plans to increase the current fuel levy applicable to GA aircraft from 2.1 cents per litre to 12.2 cents per litre.

Whilst the Airlines Association of South Africa, represented by Mr Chris Zweigenthal, welcomed the proposal, GA representatives were unanimous in their concern about the inherent problems that such a drastic increase would bring with it.

1. AMENDMENT TO CIVIL AVIATION REGULATIONS

Gazette 32866 dated 11 January 2010 has been published and contains a number of proposed amendments to the Civil Aviation Regulations (CARS).

The majority of the changes relate to amendments to Part 62 of the CARS but the Gazette also includes Amendments to Part 12, 61, 139, 172 and 178.

Please note that comment on these proposals needs to reach the SACAA by 11 February 2010. Contact details are included in the Gazette.
